In a bid to improve the H-2B program, the U.S. Labor Department has proposed revision of the program. The H-2B program which facilitates the entry of foreign workers temporarily into U.S. when qualified U.S. recruits are not available in the country is restricted by law to an annual ceiling of 66,000 visas.
Seeking to ensure that U.S. workers receive the same level of protection and benefits as temporary foreign workers recruited under the H-2B program, several facets of the temporary nonagricultural worker program will undergo a change.
The improved H-2B program will also prove to be advantageous for employers. Besides providing them with better access to lawful labor needs, the H-2B program will entail an H-2B registration process, enabling employers to carry out labor market tests closer to their date of need prior to applying for a certification.

Whilst the proposed rule will guarantee a fair treatment to the H-2B foreign workers; on the other hand it will provide U.S. workers with better access to jobs.

In order to enhance U.S. workers’ access to jobs, the U.S. Labor Department has further proposed to establish a national job registry for all H-2B job postings.

The proposed rule will certainly improve and provide U.S. workers with better access to jobs as well as offer enhanced benefits and protection. But what implications does this hold for foreign workers?

I would like to add one more important point here. The U.S. Labor Department proposes to extend the H-2B program benefits to workers working alongside those employed under the H-2B program. Apart from assigning the department’s Wage and Hour Division independent debarment authority, the proposed rule will also necessitate employers to pay transportation costs and other fees.
